Effective dispute resolution

Firm Philosophy

Jennifer Wherry is dedicated to reducing the stress of the family law process as much as possible so clients can move forward and worry less. Known for her honesty and caring approach, she helps clients resolve family disputes effectively and privately using the collaborative divorce process and mediation which are part of what is known as the alternative dispute resolution process.

The court system's litigation process is often not a "family friendly" or a "child friendly" environment to resolve family disputes such as divorce, custody or child support issues. Parents, spouses, relatives and friends are sometimes forced to take sides in a courthouse dispute that pits the parties against each other in a litigation "war."

There are many family disputes that can be resolved more peaceably and less destructively using the alternative dispute resolution process, which embraces the concept of interest-based negotiations. Many times by focusing on the specific needs, interests and concerns of the parties, a "win/win" resolution can be more easily discovered than by focusing on what a court or jury will or will not do with a certain set of facts.

Collaborative divorce and mediation are two of many options available for parties to resolve their disputes. Of course, the best option for each case will depend on the facts, finances, goals and personalities involved.

While no one dispute resolution process will be right for every case, in many situations the collaborative divorce process may offer advantages over trying to resolve the dispute in the litigation process. The Collaborative Divorce Institute of Texas offers a helpful comparison divorce between the collaborative law process and the litigation process. Click here to learn more.
